Update: Judge overrules motion to toss confession in child abuse death case

Judge David Mouton ruled that Jalen Vaden did not invoke his right to counsel during an interrogation with a Jasper County deputy last December.

His attorney had argued that Vaden was asking for an attorney when he asked, “Is Judd here?” Apparently, referring to Judd McPherson who is the victim’s grandfather. However, mouton said that did not meet the standard as a “unambiguous, unequivocal and specific request for counsel.”

The 22-year-old Carl Junction man is accused in the death of Jayda Kyle. He was the live in boyfriend of Kyle’s mother and allegedly threw the 3-year-old to the ground, causing abusive head trauma. Kyle passed away less than a week later.
