David Bennett Junior was read his formal charges this afternoon in Oswego.
PARSONS, KS.--- A Cherryvale man charged with killing a Parsons woman and her three children appears in court. David Bennett Junior, 22, was read his formal charges this afternoon in Oswego. Kansas Attorney General Derek Schmidt charged Bennett with one count of capital murder for the deaths of Cami Umbarger, 29, and her children: Hollie, 8, Jaxon, 5, and Averie, 4.

The four were found dead in their Parsons home last week. In the alternative to the capital murder charge, Schmidt filed four counts of first degree premeditated murder. Bennett is also charged with one count of rape and two counts of criminal threat. The criminal complaint in the case states the murders happened between November 23rd and the 25th.

The document also says Bennett raped Cami Umbarger on or around November 23rd. It lists two separate felony incidents of criminal threat where Bennett threatened violence to Cami Umbarger. District Judge Robert Fleming has appointed Attorney Ron Evans to represent Bennett in court. His next court appearance will be January 17th in Oswego. Bennett remains in custody in the Labette County Jail on a $5 million bond.
